Pedal Boat Rental Agreement
This Agreement is made and entered in this ___ day of _______________, 20___,
between Bahamas Beachside Properties LLC, hereinafter called "Owner",
and __________________________, hereinafter called "House Renter".

Pedal Boat
The pedal boat which the Owner hereby agrees to rent:
a KL Industries Sun Slider 5-Person Pedal Boat With Stainless Steel Crankshaft CREMBLUE 427708
The Owner represents that to the best of his knowledge and belief that said pedal boat is in
sound and safe condition and free of any known faults or defects which would affect its safe operation under normal use.

Use of Pedal Boat:
The Owner agrees to rent the above-described pedal boat to the Renter on a weekly basis at $120. per week.
The Renter agrees: (a) that the rented pedal boat shall not be used only for pleasure and not to carry any passengers
for hire; (b) that the rented pedal boat shall not be used to carry passengers and luggage or accessories in excess of the capacity of 800 lbs thereof;
(c) that the pedal boat will only be used within 20 feet of land of Long Island and not to use the pedal boat out at sea or on the Atlantic Side of Long Island
(d) not to use the boat while drinking or sunbathing (as people have a tendancy to fall asleep which could cause them to drift away from shore out to sea);
(e) not to use the pedal boat for any illegal purpose; (g) not to operate the pedal boat in a negligent manner;
(f) not to permit the vehicle to be operated by any other person without the written
permission of the owner; and (i) not to be used by anyone under the age of 18 without their legal guardian in the pedal boat wtih them..
(g) the renter will bring their own life jackets with them in the boat and wear them at all times.
(h) no more than 5 people will be in the pedal boat at any time
(i) TO RINSE THE UNDERSIDE OF THE PEDAL BOAT AFTER EACH USE to free it from salt water. This must be done after each use while trying to conserve water.
You may choose to pay our cleaning staff to come out and rinse it daily for them for $25 a day. Please specify at the bottom of this form.
(j) the Houe Renter agrees to keep the boat locked in place while not in use to prevent it from floating away or being stolen.
(k) to place the pedal boat back into it's originally spot prior to leaving the house as our housekeeper cannot lift it by herself. Renter may choose to leave it elsewhere however, a $50 fine will
apply because we must hire someone else to come and lift it back into place. It takes two people to lift the 110 lb pedal boat.

Insurance
The House Renter hereby agrees to take out their own insurance on the pedal boat as it is not under the owners insurance.

Liability
The House Renter agrees to assume all risk and liability associated with the rental and use of the pedal boat.
The House rental assumes all liability for the pedal boat and the House Renters own actions and any other persons on the pedal boat with them.
The House renter agrees to indemnify and hold harmless the Bahamas Beachside Properties LLC, DeBora Bernick and family, and
DeBora Rachelle Inc from any loss or liability that may arise as a result of renting this pedal boat.

Daily rinsing:
Due to the fact that this pedal boat will be used in salt water, House Renter agrees to rinse the pedal boat after each use with fresh water (not salt water) especially rinsing the metal pedal work underneath the pedal boat.
___ Yes, I would like the House Renters Cleaning staff to come out, rinse and cover the boat daily for and additional $25 per day or $175 a week.
___ No, I will take the responsibility of rinsing and covering the boat daily at no charge to me.

Putting pedal boat back in it's original location:
___ Yes, I will make sure the pedal boat is placed back into it's original location and chained to the palm tree prior to my leaving Long Island, Bahamas.
___ No, please hire staff to put the pedal boat back into it's original location. I realize I will be charged an extra $50. handling fee to do this.

Lost, Stolen, or Damage of Pedal Boat:
House Renter agrees if the pedal boat is lost, stolen or damaged while in their posession, they will replace the pedal boat with a new pedal boat just like (KL Industries Sun Slider 5-Person Pedal Boat With Stainless Steel Crankshaft CREMBLUE 427708) and have it shipped directly to Long Island paying all associated duties, taxes and costs of the pedal boat.
